This project receives co-funding by the COSME programme of the European Union under grant agreement No 101036225.
The DrugDetect project aims to procure an innovative solution for the automatic detection of a large range of drugs in correctional institutions and prisons, that is available 24/7, does not cause delays in internal processes, does not require minimal human intervention, and is GDPR compliant.
Following the identified needs and the market analysis, the DrugDetect Buyer’s Group decided to pursue 3 Lots during the present procurement procedure:
Lot 1 – Identification of drugs
Lot 2 – Detection of drugs inside packages/luggage and
Lot 3 – Detection of drugs on the body.

The solution proposed by the Tenderer must comprise one or more innovative components or one or more architectural innovations. The Drug Detect procurement does not include the procurement of research and development (R&D).
In particular, the proposed solution must comprise new or significantly improved components or architecture that have already been (partially) demonstrated on a small scale and may be nearly or already available in small quantities on the market, but which have not been widely adopted yet. Typically, owing to the residual risk or market uncertainty, these innovative components or architecture have not been produced at a large enough scale. This also includes existing solutions that are to be utilised in a new and innovative way.
Whether a component or architectural feature is innovative will be assessed by the Drug Detect consortium according to the following three cumulative minimum requirements:
1. The innovative component or architectural innovation must be related to innovation aspects indicated as important for the given lot.
2. The difference in time between first deployment of the device/solution, which is equipped with such a component or is based on such architectural innovations, and the date, when the given Tender was due for submission, must not exceed 24 months.
3. Finally, the component or architectural innovation in question must not have been used for more than 50 clients.
These cumulative minimum requirements will be assessed for each bid submitted. Final Tenders that do not conform to this minimal requirement will be excluded.
In Lot 1, the Buyers’ Group is interested in the following innovative features:
Artificial Intelligence to support recognition of substances
Detection without opening a package/luggage
Increase the number of drugs that can be detected
Improved accuracy of detection
Increased speed of detection
Minimal operator interaction
Integration with other relevant functionalities such as air sampling/X-ray/millimeter wave scans

The contracting authority involved in the DrugDetect project is not legally bound in any way by the outcome of the market consultation. The open market consultation will provide an overview on the procurement objectives, the PPI process and the main clauses of the contract. It is also not part of any pre-qualification or selection process. No advantage or disadvantage will be given to any supplier / group of suppliers to the detriment of others during the market consultation and the sub-sequent competitive procedure for the award of contracts procurement.

The submission of a tender implies unconditional acceptance of all terms and conditions contained in this Call. Under penalty of exclusion, tenders must not contain any reservation in relation to any point in the Tender terms and conditions.
If the Tenderers have any complaints about the contents of the tendering documents – specifically, but not exclusively, regarding exclusion, selection, pass/fail and weighted award criteria – they must submit them to the Lead Procurer within ten (10) days of the publication of the Call on TED. If the dispute is not solved amicably, the Tenderer may lodge an appeal with the Greek Administrative Court of Appeal of Athens within five (5) days of the decision of the Lead Procurer. Failure to submit an appeal within these deadlines leads to termination of the right to appeal (on a later stage and on other grounds) and to participate in the DrugDetect PPI.
All possible complaints during the tendering process will be solely submitted to the Lead Procurer within ten (10) days following the notification of the final decision – as described in step 7 of section 3.7 - of the CB. Complains will not be addressed to the other members of the Buyer’s Group or the EC.
Submission of complaints shall not lead to unreasonable delays in the evaluation and award procedures.
The Lead procurer, the members of the Buyer’s Group and/or the EC will not be liable for any loss or damage that the tenderer may suffer in preparing and submitting a bid for this PPI.
The Lead Procurer will forward the complaints to the EvC which is responsible to evaluate the complaints and to submit its opinion to the CB for final decision.
Possible complaints against any final decision of the CB may be reviewed by the Greek Administrative Court of Appeal of Athens.4 The tenderers are mandated to notify the Lead Procurer in writing that they are submitting an appeal to challenge a decision of the CB.
Any dispute or claim arising in connection with the execution of the contracts shall be heard by Greek Administrative Court of Appeal of Athens.
